DELAWARE COUNTY CRIMINAL HEARINGS TO UNDERGO MAJOR CHANGES.

On April 25, 2013, the Supreme Court of Pennsylvania  adopted changes to the rules of Criminal Procedure that will impact many cases at the Preliminary Hearing level.

Beginning on June 1, 2013, the Commonwealth will be able to introduce hearsay evidence in any type of case including assault cases, drug cases, burglary, and DUI. In other words, the Commonwealth will be able to proceed with the case even without a victim being present and without an opportunity for the defendant to face his or her accuser. If the Commonwealth is able to indicate to the District Justice that the witnesses and/or victims will be available for a trial at the Court of Common Pleas Courthouse, they will be able to proceed with hearsay testimony by Police Officers and bypassing the Confrontation Clause of the Constitution.
