Can the Police Arrest me for a DUI while on a bicycle?

Unfortunately, the  answer is YES. According to the PA Vehicle Code, Section 102, we find the following: “Vehicle.” Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices used exclusively upon rails or tracks. The term does not include a self-propelled wheel chair or an electrical mobility device operated by and designed for the exclusive use of a person with a mobility-related disability.

As such, Delaware County Police, and Pennsylvania State Police can stop and arrest you for a DUI even if operating a bicycle. If you are stopped or arrested for a DUI, you should consult one of our experienced attorneys to help you with your case.
