In order to arrest someone or obtain an arrest warrant from a judge, the police need probable cause. The police must be able to point to specific, objective factors that led them to believe that a person committed a crime.

For example, if you were pulled over, the officer should be able to articulate a reason for the stop, such as speeding, making excessively wide turns, swerving in and out of lanes, or otherwise showing signs of intoxication behind the wheel. If the officer suspected you of being under the influence of drugs or alcohol, then they must be able to point to specific observations in your behavior and speech, as well as whether or not there is the presence of bloodshot eyes or the scent of alcohol on your breath.

Also known as field sobriety tests, chemical tests are conducted before an arrest for DUI by collecting a sample of blood, urine, or breath. The purpose of the test is to determine if a driver is under the influence of alcohol or another controlled substance while operating a motor vehicle and if they are intoxicated. Because they can be done on the side of the road, they are a preferred method of testing by law enforcement. An attorney can argue that the sample was contaminated or was not drawn by someone qualified to administer the test, among other legal defenses.

DUI LAWS IN MEDIA, PA

The General Assembly of the Commonwealth of Pennsylvania enacted a new law in 2003 that lowered Pennsylvania's legal limit of alcohol from .10% to .08%. It also created changes to the fines, terms of suspension, and other penalties for breaking the law. Act 24 lays out all the legal penalties for DUI violations involving alcoholic beverages, chemical substances, or controlled substances. They are broken down into the following.

First DUI Offense

A first conviction comes with a $300 fine and up to 6 months of probation. There is no mandatory jail time, license suspension, or ignition interlock device (IID) installation.

However, if your blood alcohol content (BAC) was higher, then the consequences are higher. If your BAC was .10% to .159%, then you could be facing fines between $500 and $5,000. Additionally, you may spend two days in jail, be required to have an IID installed in your car for one year, and your license may be suspended for a year.

Second Offense

With your second offense, you could be facing fines between $300 and $2,500. You could also be facing:

  • Five days in jail
  • Six months of probation
  • Having your license suspended for 12 months
  • Having an ignition interlock device installed in your car for at least one year

Just like with a first offense, if your BAC was .10% to .159%, or .16% or higher, then the fines are higher. In these cases, the fines will be between $750 and $5,000, or even more.

Third Offense

If you have had a third conviction within ten years of your second DUI conviction, then you could be facing fines between $500 and $10,000, depending on your BAC, just like in prior convictions. You could also face:

  • Between 10 to 365 days in jail
  • A 12-18 month driving suspension
  • Between two and seven years of probation

Fourth and Subsequent Convictions

When you are facing your fourth conviction within ten years of your third, then you are facing third-degree felony charges and a maximum jail sentence of seven years. Additionally, your driver's license will be suspended for 18 months. Once reinstated, you would need to have an eye ID installed in your car for at least one year. If your BAC was between .08% and .099%, then the consequences are the same as if your BAC was .16% or higher.
